These Terms of Service ("Terms") constitute a legally binding agreement between you and SafeSiteX, Inc. ("SafeSiteX," "we," "our," or "us"), governing your access to and use of the SafeSiteX website at safesitex.com ("Website") and the SafeSiteX industrial safety compliance and incident prediction platform and related services ("Services").
By accessing the Website, creating an account, or using any part of the Services, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms, in which case "you" refers to that entity.
If you do not agree to these Terms, you may not access or use the Website or Services. We reserve the right to update these Terms at any time as described in the "Changes to Terms" section below.

The specific features available to you depend on your subscription plan as described on our Pricing page and as specified in your subscription agreement. SafeSiteX reserves the right to modify, enhance, or discontinue any feature or aspect of the Services with reasonable notice to customers.
Regulatory Disclaimer. The Services are designed to support your organization's safety compliance management processes. SafeSiteX does not provide legal advice, regulatory compliance certification, or guarantee that use of the Services will result in OSHA compliance or eliminate the possibility of regulatory citations. Compliance with applicable laws and regulations remains the responsibility of your organization. Our EHS team can provide general information about OSHA standards as a support function, but such information does not constitute legal advice.
To use the Services, you must create an account by providing accurate and complete registration information including your name, business email address, company name, and billing information. You are responsible for maintaining the accuracy of your account information and updating it as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at contact@safesitex.com if you become aware of any unauthorized access to or use of your account.
You may not share account credentials with users outside your organization, create accounts on behalf of other organizations without their authorization, or use automated methods to access the Services except through our published APIs. You are responsible for ensuring that all users within your organization who access the Services comply with these Terms.
SafeSiteX reserves the right to suspend or terminate accounts that violate these Terms, are used for fraudulent or unlawful purposes, or are found to misrepresent the account holder's identity or organization. We will provide reasonable notice before termination except where immediate termination is necessary to protect the integrity of the Services or other customers.
Access to the paid features of the Services requires a subscription. Subscription plans, pricing, and included features are described on our Pricing page at safesitex.com/price.html. All prices are in United States Dollars (USD) and are exclusive of applicable taxes unless otherwise stated.
Billing Cycles. Subscriptions are billed monthly or annually depending on the plan selected. Annual subscriptions are billed in advance for the full subscription year. Monthly subscriptions are billed in advance for each calendar month.
Payment Method. You authorize SafeSiteX to charge your designated payment method for all fees owed. If a payment fails, we will notify you and may suspend access to paid features until outstanding fees are resolved. We reserve the right to apply a late payment fee for accounts with balances more than 30 days past due.
Subscription Changes. You may upgrade your subscription plan at any time; the upgrade takes effect immediately and is billed on a pro-rated basis for the current billing period. Downgrade requests take effect at the next billing cycle. Downgrading below the plan tier required to support your current usage may result in reduced access to features or data; we will notify you of such implications before processing a downgrade.
Cancellation. You may cancel your subscription at any time through your account settings or by contacting us at contact@safesitex.com. Cancellation takes effect at the end of the current billing period. Annual subscriptions cancelled before the end of the subscription year are not eligible for pro-rated refunds unless cancellation is due to a material breach of these Terms by SafeSiteX.
Refund Policy. SafeSiteX does not offer refunds for partial subscription periods except in cases of material service failure directly attributable to SafeSiteX or as required by applicable consumer protection laws. Refund requests should be submitted within 30 days of the applicable billing date.
SafeSiteX Intellectual Property. The Website, platform software, algorithms, user interface, documentation, and all related content are owned by SafeSiteX or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws. SafeSiteX grants you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes during the term of your subscription. This license does not include the right to sublicense, modify, reverse engineer, decompile, or create derivative works based on any component of the Services.
Your Data. You retain all rights to the safety and compliance data, incident records, and other content you upload or generate through the Services ("Your Data"). By using the Services, you grant SafeSiteX a limited license to process, store, and use Your Data as necessary to provide the Services and as described in our Privacy Policy. You represent that you have the right to provide Your Data and that its processing will not violate any third-party rights or applicable law.
Feedback. If you provide suggestions, feature requests, or other feedback about the Services ("Feedback"), you grant SafeSiteX a royalty-free, worldwide, perpetual license to use that Feedback for any purpose without obligation to you. We are not required to act on Feedback and will not disclose its source without your permission.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:
SafeSiteX provides the Services on an "as available" basis and does not guarantee uninterrupted availability. We target 99.5% monthly uptime for the platform, excluding scheduled maintenance windows announced with at least 48 hours' advance notice. Planned maintenance is typically scheduled during off-peak hours on weekends.
Customer support is available via email at contact@safesitex.com and by phone at +1 (412) 529-6718 during business hours (9:00 AM to 6:00 PM Eastern Time, Monday through Friday, excluding federal holidays). Support response times depend on the severity of the issue and the customer's subscription plan as specified in the service level terms applicable to each plan tier.
Each party agrees to keep confidential the other party's non-public business information that is disclosed in connection with the Services and designated as confidential or that a reasonable person would recognize as confidential given the circumstances of disclosure. This obligation does not apply to information that becomes publicly available through no fault of the receiving party, was known prior to disclosure, or is required to be disclosed by law or legal process.
SafeSiteX treats all customer safety data, facility information, and business information as confidential and does not disclose it to third parties except as described in our Privacy Policy or as required by law. Aggregated, de-identified data may be used for research and benchmarking purposes as described in the Privacy Policy.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. SAFESITEX DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR THAT DEFECTS WILL BE CORRECTED.
SAFESITEX DOES NOT WARRANT THAT USE OF THE SERVICES WILL RESULT IN OSHA COMPLIANCE, REDUCED INJURY RATES, PREVENTION OF REGULATORY CITATIONS, OR ANY SPECIFIC SAFETY OUTCOME. THE SERVICES ARE A TOOL TO SUPPORT YOUR SAFETY MANAGEMENT PROCESSES; COMPLIANCE AND SAFETY OUTCOMES DEPEND ON ORGANIZATIONAL DECISIONS AND ACTIONS OUTSIDE SAFESITEX'S CONTROL.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SAFESITEX, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF SAFESITEX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SAFESITEX'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS PAID BY YOU FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00). THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE FORM OF ACTION.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the extent permitted by law.
You agree to indemnify, defend, and hold harmless SafeSiteX and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services in violation of these Terms; (b) Your Data or your use of the Services to process data in violation of applicable law or third-party rights; (c) your violation of any applicable law or regulation; or (d) any misrepresentation you make in connection with these Terms or your account registration.
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without giving effect to any conflict of law principles that would require application of the laws of another jurisdiction.
Any dispute arising out of or relating to these Terms or the Services that cannot be resolved through good-faith negotiation between the parties will be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration will be conducted in Pittsburgh, Pennsylvania. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending resolution of a dispute by arbitration. You and SafeSiteX each waive any right to a jury trial for any claim covered by these Terms.
Either party may terminate the Services by cancelling the subscription as described in the Subscription and Payment section. SafeSiteX may also terminate or suspend your access to the Services immediately and without notice if you materially breach these Terms, engage in fraudulent or illegal activity, or if required by law.
Upon termination of your subscription, your license to use the Services terminates. We will provide you with the ability to export Your Data for a period of 30 days following subscription termination. After this period, Your Data will be deleted from our systems in accordance with our data retention policy, except for records subject to regulatory retention requirements.
Sections of these Terms that by their nature should survive termination will survive, including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.
SafeSiteX reserves the right to update these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, for significant changes, by providing advance notice by email to the primary account email address associated with your subscription.
Your continued use of the Services after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree with updated Terms, you may cancel your subscription before the effective date of the changes.
Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and SafeSiteX regarding the Services and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
Waiver. SafeSiteX's failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Assignment. You may not assign these Terms or your account without our prior written consent. SafeSiteX may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets.
